1. Acceptance of Terms

By accessing or using Perfcycle AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced herein. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Perfcycle AI is a performance review assistance tool designed to help users generate, refine, and review self-assessment content based on user inputs. The Service provides partial previews and requires payment for access to full results and refinement options. Please note: Perfcycle AI does not guarantee outcomes of any generated content.

3. User Accounts

You must create an account using a valid email address and password to access and use the Service. You are responsible for maintaining the security of your account credentials. Perfcycle AI reserves the right to terminate or suspend accounts found to be in violation of these Terms.

4. Uploaded Documents and Data Processing

Uploaded documents are used solely for data extraction and are deleted immediately after processing. However, extracted data, conversation history, and generated content are retained until manually deleted by the user, or the account is closed. By using this Service, you confirm that you have the legal right to submit any data or documents and acknowledge that Perfcycle AI assumes no liability for any user violation of NDAs or employment agreements.

5. Subscription, Payment, and Refunds

Perfcycle AI offers a paid subscription service that provides access to full results and advanced refinements. Payments are processed through Stripe. You may cancel your subscription at any time. We offer a money-back guarantee if you are dissatisfied with the results. However, we make no guarantees regarding the acceptance or outcome of the content generated by this Service. The accuracy and effectiveness of generated content depend solely on the quality of user-submitted inputs.

6. Limited License and Content Ownership

By submitting content to Perfcycle AI, you grant us a non-exclusive, royalty-free, worldwide, and sublicensable license to use, store, and process your content for the purpose of providing the Service and improving our models. Users retain ownership of their generated content in alignment with OpenAI's policy. However, Perfcycle AI may use anonymized or aggregated data to enhance the Service.

7. Use of Third Party LLM Providers

Perfcycle AI utilizes Anthropic's API to generate and refine user content, and OpenAI's API to generate content embeddings (only relevant to Team plans). By using this Service, you consent to the processing of your data by Anthropic in accordance with their Privacy Policy: https://www.anthropic.com/legal/privacy.

8. Limitation of Liability

Perfcycle AI assumes no responsibility for the accuracy, completeness, or timeliness of generated content. The Service is provided on an "as-is" basis, without warranties of any kind. Users are responsible for ensuring that content is appropriate for their intended use, including performance reviews. Perfcycle AI disclaims liability for any direct or indirect damages arising from the use of the Service.

9. Prohibited Uses

You agree not to use the Service for any unlawful, misleading, or abusive purposes, including but not limited to:

• Violating the intellectual property rights of others.
• Uploading sensitive or confidential information without proper authorization.
• Misrepresenting or impersonating others.

Perfcycle AI reserves the right to suspend or terminate access to users found engaging in prohibited activities.

10. Changes to the Service and Terms

Perfcycle AI may modify or terminate the Service at any time, with or without notice. We reserve the right to update these Terms. Changes will be effective upon posting, and continued use of the Service indicates acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Delaware, USA. Any disputes arising from these Terms or the use of the Service will be resolved in the courts of Delaware, USA.

Privacy Policy

Perfcycle AI is committed to protecting your privacy. This Privacy Policy outlines our practices regarding the collection, use, and sharing of your information.

1. Information We Collect

We collect information that you voluntarily provide when creating an account, uploading documents, or using the Service. This may include:

• Personal Information: Your email address, password, and any additional profile details you provide.
• Document Content: Documents you upload (PDF, DOCX, PPTX formats) are used for data extraction and are deleted immediately after processing.
• Generated Content: Content generated through the Service, as well as the user-provided inputs used to create this content, is retained until manually deleted by the user, including:
  • Project updates
  • Performance reviews
  • Peer reviews
  • Career highlights
  • Templates
• Usage Data: We collect information about how you interact with our service, including:
  • Features used
  • Time spent using the application
  • Actions taken within the application
  • Device and browser information
• Slack Integration Data (Team Plan Only): If you enable the Slack integration, we collect:
  • Workspace and channel information
  • User mappings between Perfcycle and Slack accounts
  • Message IDs for notifications sent through Slack

2. How We Use Your Information

• To Provide the Service: We use your information to create, refine, and deliver professional documentation and performance review content.
• Improving the Service: Anonymized and aggregated data from user interactions may be used to enhance our AI models and overall service quality.
• Transaction Processing: If you subscribe to our paid services, payment information will be securely processed through Stripe.

3. Data Sharing and Confidentiality

Perfcycle AI does not share your personal data, generated content, or document information with your employer or any third party, except:

• With Anthropic: Data is shared with Anthropic solely for generating content through their Claude API.
• With OpenAI: Data is shared with OpenAI solely for generating embeddings through their API (for Teams accounts only).
• For Legal Compliance: We may disclose information as required by law, regulation, or court order.
• With Slack (Team Plan Only): For teams using the Slack integration, limited data is shared with Slack to facilitate notifications and messaging features.
• Team Visibility (Team Plan Only): Content may be shared with team managers based on visibility settings configured by users.

Please note: Users are solely responsible for ensuring compliance with any NDA or employment agreements regarding confidential information submitted to Perfcycle AI. We assume no liability for any breaches resulting from a user's unauthorized disclosure of confidential data.

4. Data Retention and Deletion

Uploaded documents are deleted immediately following data extraction.

Extracted data and generated content are retained until:

• The user manually deletes the item in their dashboard
• The user account is terminated
• A valid legal request requires deletion

User accounts can be terminated at any time.

5. User Rights and Data Security

• Access and Control: Users can access, download, and delete specific content items through their dashboard.
• Data Security: We implement industry-standard security measures to protect your information from unauthorized access, use, or disclosure. However, we cannot guarantee absolute security.

6. California Residents' Rights

Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), California residents have the following rights:

• Right to Know: You have the right to request information about the personal information we collect, use, disclose, and sell.
• Right to Delete: You can request deletion of your personal information, subject to certain exceptions.
• Right to Opt-Out of Sale: We do not sell your personal information as defined by California law.
• Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
